[PRESS RELEASE] Lupi Barista’s staan op tegen onrecht en uitbuiting // Lupi Baristas say No to Injustice and Exploitation.

Een groep van 6 barista’s en doe-het-zelf vakbond Horeca United eisen looncompensatie en verandering van bedrijfsvoering van Lupi Coffee, een keten van espressobars die hun personeel structureel uitbuit.Het doel van de campagne is ervoor te zorgen dat de werknemers worden betaald waar ze recht op hebben en om ervoor te zorgen dat anderen in de toekomst niet in dezelfde situatie terechtkomen.Tot nu toe weigert de eigenaar van het bedrijf in te gaan op hun eisen.De bond heeft verschillende flyeracties gehouden in Den Haag en Leiden. Zondag 27 augustus is er een demonstratie in Den Haag.

Onaanvaardbare arbeidsvoorwaarden en contracten

Slechte arbeidsomstandigheden zijn helaas niets nieuws in de horeca. Voor nieuwe werknemers bij Lupi Coffee komen de twijfels al voordat hun contract is getekend. Voordat ze als barista aan de slag mogen, moet een verplichte cursus naar tevredenheid van de werkgever worden afgerond. Deze ‘baristacursus’ kost de werkers €290 voor de eerste dag. Na het voltooien van de cursus kregen barista’s een contract vol illegale bepalingen, dat naar verwachting onmiddellijk zou worden ondertekend. Eenmaal aan het werk worden de misstanden duidelijk. Ten eerste werd van werknemers verwacht dat ze 10 uur per dag werkten zonder pauzes. Het uurloon lag onder het minimumloon volgens de CAO Horeca. Bovendien werden zij gedwongen om om 18.00 uur uit te klokken en vervolgens de winkel schoon te maken in hun eigen tijd, terwijl het wel bij het werk hoorde. Toen sommige barista’s ontslag namen, werd er €290 of €580 van hun laatste loonbetaling ingehouden ‘voor de cursus’. Verschillende ex-werknemers besloten hulp te zoeken bij doe-het-zelf vakbond Horeca United. Sinds juni voeren ze samen campagne voor compensatie en een verandering van werkomstandigheden bij Lupi Coffee.

Intimidatie van arbeiders die voor hun rechten vechten

Nadat een aangetekende eisenbrief gericht aan de eigenaar niet werd beantwoord, begon de vakbond te flyeren bij de vestigingen van Lupi Coffe in Leiden en Den Haag. Deze escalatie verontrustte Hossein Akef, de eigenaar, diep, en hij besloot op zijn eigen manier wraak te nemen. De avond na een zo’n actie in Den Haag vond Defne, een van de ex-werknemers die die dag bij het evenement aanwezig was, overal in haar huis en buurt posters. Op de posters stond haar naam, gezicht en volledig adres, waarop stond dat Defne, die onlangs uit Turkije was geëmigreerd, geld van Lupi had gestolen en ermee was weggelopen, en dat ze goed was in het werken met haar handen en meer… De racistische en seksistische ondertoon van zijn tekst heeft de barista’s en Horeca United laten zien dat hij hen totaal niet respecteert. Uiterraad is er aangifte gedaan bij de politie. Defne is sindsdien bang geworden voor het beantwoorden van deurbellen, uit angst voor een ongevraagde confrontatie met haar ex-baas.

Waarom deze zaak ertoe doet – uitbuiting in de horeca

Deze zaak weerspiegelt de trieste realiteit van het grootste deel van de horecasector in Nederland: straffeloosheid, corruptie, intimidatie en apathie van de autoriteiten. Werknemers worden overgelaten om zelf oplossingen te vinden of geven het op en zoeken naar een nieuwe baan waar dezelfde situatie zich zal herhalen. Voor de horecamedewerker met een onzeker 0-urencontract zijn de door de staat aangeboden middelen schaars en migranten krijgen geen middelen om er toegang toe te krijgen. Het personeelstekort blijft een serieus probleem in de horeca, terwijl horecapersoneel nog steeds tot de slechtst betaalde werknemers van Nederland behoort in vergelijking met andere sectoren. Werkgevers geven de hoge kosten van het runnen van een horecabedrijf de schuld van het ontbreken van een behoorlijke vergoeding; ze klagen ook dat het moeilijk is om meer werknemers aan te trekken. De vraag waarom zoveel werknemers vertrekken en nooit meer terugkeren naar deze sector lijkt een zinloze vraag om te stellen. Het gedrag van Akef laat zien hoe comfortabel horecabazen zich voelen bij het schenden van arbeidsrechten zonder consequenties. De intimidatie die Defne ontving, bewijst dit punt verder. De Nederlandse regering is medeplichtig door de CAO niet te handhaven en middelen voor werknemers moeilijk te bereiken – vooral in het geval van jonge arbeidsmigranten. De geringe frequentie van arbeidsinspecties en het uitblijven van echte consequenties staan het toe dat werkgevers de regelgeving volledig omzeilen.

Tijd voor actie: steun de Lupi-arbeiders

Na de publicatie van de campagne en de irrationele reactie van Akef zijn twee politieke partijen (Haagse Stadspartij en SP) van plan schriftelijke vragen in te dienen bij de Haagse gemeenteraad naar de handelspraktijken van Lupi Coffee. Verdere steun komt van doorbraak.eu die zich bij de acties hebben aangesloten en op hun website over de zaak berichtten. Talloze mensen toonden hun steun door online hun mening te geven en zelfs de winkellocaties binnen te gaan om hun verontwaardiging met het management te delen. De flyeracties gaan door, maar de eigenaar lijkt niet bereid om met de vakbond om tafel te gaan zitten. Via zijn advocaat dreigt hij ongegrond met juridische stappen. Horeca United laat zich niet intimideren door deze praktijken en kondigt een demonstratie aan op 27 augustus in den Haag. Updates worden op www.horeca-united.nl geplaatst.

A group of 6 barista’s and DIY union Horeca United are demanding wage compensation and a change of business practices from Lupi Coffee, a chain of espresso bars that structurally exploits their staff. The objective of the campaign is for the workers to be paid what they are rightfully owed, and to make sure that others do not find themselves in the same situation in the future. So far, the company’s owner refuses to agree to their demands. The union has held several flyering actions in den Haag and Leiden. Sunday 27th of August, there will be a demonstration in the Hague.

Unacceptable labor conditions and contracts

Poor working conditions are unfortunately nothing new in horeca. At Lupi Coffee, the red flags start even before the contract is signed. Before being allowed to work as a barista, a mandatory course had to be completed to the employer’s satisfaction. This ‘barista course’ costs the workers €290 for the first day. After completing the course, barista’s got handed a contract filled with inconsistencies, expected to sign immediately. When work starts, the workers quickly realized that there were great discrepancies between the contract and what was really happening. Firstly, they were expected to work 10 hour shift without proper breaks. The hourly wage was below the minimum wage according to the Horeca CAO. On top of all of this, workers were forced to clock out at 6 PM and then clean the store. The cleaning was not being paid out even though it was part of the job. After quitting their jobs, workers had further costs for this ‘course’ deducted from their wage slips (€290 or €580).

Several ex-employees decided to seek help from DIY union Horeca United. Since June, they have been campaigning together for compensation and a change of business practices at Lupi Coffee.

Intimidation against workers fighting for their rights

After a signed demand letter adressed to the owner didn’t get answered, the union started to go flyering at Lupi Coffe’s branches in Leiden and the Hague. This escalation deeply disturbed Hossein Akef, the owner, and he decided to retaliate in his own way. The evening after the flyering in the Hague, Defne, one of the ex workers that joined the event that day, found posters all around her house and neighborhood. The posters had her name, face and full address on them, claiming that Defne, who had recently migrated from Turkey, had stolen money from Lupi and ran away with it, and she was good with working with her hands and more… The racist and sexist undertones of his text has shown the workers and HU that he does not respect them one bit. Needless to say, the incident has been reported to the police. Defne has since become scared of answering door bells, fearing an unsolicited confrontation with her ex boss.

Why this Case Matters – Horeca in NL

This case only reflects the sad reality of the horeca sector for most of the Netherlands: impunity, corruption, intimidation, and apathy from the authorities. Workers are left to find solutions on their own or give up and search for a new job where the same situation will be repeated. For the precarious 0-hour contract horeca worker the resources offered by the state are scarce and migrants are not provided with tools to access them.

The staff shortage remains a serious problem in the hospitality sector, while at the same time horeca workers remain some of the worst-paid employees in the Netherlands compared to other sectors. Employers blame the high costs of running a horeca business for the lack of proper compensation; they also complain that it is hard to attract more workers. The question of why so many workers leave and never return to this sector seems like a pointless question to ask.

Akef’s behaviour shows how comfortable horeca bosses feel abusing labor rights with no consequences. The intimidation that Defne received further proves this point. The Dutch government is complicit by not enforcing the collective labor agreement, and making resources for workers hard to reach – especially in the case of young migrant workers. The infrequency of labor inspections and the lack of real consequences has given employers the false pretense of leniency to bypass the regulations completely.

Time for Action: Support the Lupi Workers

After the publication of the campaign and the irrational reaction of Akef, 2 political parties (Haagse Stadspartij and Socialistische Partij) plan to open an official inquiry in Den Hague’s city council about the business practices of Lupi Coffee. Further support comes from doorbraak.eu who joined the actions and reported about the case on their website. Countless people showed support by voicing their opinions online and even entering the shop locations to share their indignation with management.

The flyering actions continue, but the owner does not seem to be willing to sit down with the union. Through his lawyer, he makes ungrounded threads of legal steps. Horeca United is not intimidated by these practises and is announcing a demonstration on the 27th of August in den Haag. Updates will be posted on www.horeca-united.nl.
